Board Authorizes Engaging Litigation
Counsel Regarding City of Lafayette Actions

After meeting in Executive Session with the Town Attorney during Tuesday night’s meeting, the Board authorized the Town Administrator to engage litigation counsel to research and report to the Town regarding actions arising from the City of Lafayette eminent domain litigation.

BACKGROUND: On February 16th of this year, the Boulder County District Court issued an Order granting the Town of Erie’s Motion to Dismiss the City of Lafayette’s Petition in condemnation of 22 acres of Town-owned property at Nine Mile Corner.  The Judge concluded that “Lafayette’s actions are more closely aligned with a previously articulated goal to ensure that Erie does engage in commercial development on Nine Mile Corner,” and “The absence of good faith bars Petitioner’s power to acquire Respondents’ property.”

Board Considers Wise Farms
Rezoning, PUD Overlay and Preliminary Plat

In three separate actions, the Board considered the Rezoning, Planned Unit Development (PUD) Overlay Map Rezoning and the Preliminary Plat for the Wise Farms residential development.  The Wise Farms property is located south of Jasper Road and west of 119th Street and is approximately 174 acres in size.

The current zoning is RR – Rural Residential.  The applicant’s proposed zoning is AG/OS – Agricultural/Open Space (87.6 acres) and ER – Estate Residential (83.8 acres).  The Wise Farms PUD Zoning Map sets the maximum number of dwelling units at 102.  The applicant is committing to dedicate two public parks of a combined 0.68 acres and 27.08 acres of Open Space which exceeds the Town’s requirements. 

The Preliminary Plat Site Specific Data:

  • Preliminary Plat Size 174 acres
  • Total Lots 10,000 – 39,999 square feet 76 lots
  • Total Lots over 40,000 square feet 26 lots
  • Total Dwelling Units 102 dwelling units
  • Number of Tracts 19 tracts
  • 2 Pocket Parks 0.678 acres
  • Open Space Dedication to Town 27 acres
  • Gross Residential Density Proposed: 0.60 dwelling units per acre

The Board will consider these matters during their April 11, 2017 meeting.
